MEET THE
TRUSTEES
Trustee Duties
Trustees are required to act honestly, with integrity, loyalty and good faith in carrying out their responsibilities. They must always act in the best interests of the trust and its beneficiaries and participate actively in the administration and decision-making of the trust.
In South Africa, the administration of trusts is primarily governed by the Trust Property Control Act 57 of 1988 (TPCA). Trustees’ duties are determined by the provisions of the TPCA, the common law and the terms of the trust deed.
Trustees owe a fiduciary duty to the trust and are expected to exercise the degree of care, diligence and skill that can reasonably be expected of a person managing the affairs of another.
Trustees act jointly on behalf of the trust and are responsible for managing the trust property in accordance with the trust deed, the TPCA and in the interests of all beneficiaries.
To fulfil these responsibilities effectively, trustees should have a thorough understanding of the trust deed, including the powers conferred on them and the objectives of the trust.
Trustees are also responsible for maintaining proper financial records. This includes keeping accurate accounting records of all transactions, maintaining an inventory of trust assets where appropriate, and ensuring that a bank account is opened and operated in the name of the trust.
Making a Change
Real People. Real Results
The strength of any trust lies in the quality, experience and commitment of its trustees. At PHT, our trustees are real people who take an active role in the administration of every trust under their care. They understand the responsibilities that accompany trusteeship and are committed to making informed, independent decisions that serve the best interests of the trust and its beneficiaries.
Drawing on practical experience in trust administration and fiduciary governance, our trustees work collaboratively to ensure that each trust is managed in accordance with the Trust Property Control Act, the provisions of the trust deed and sound governance principles. Their focus is on protecting trust assets, maintaining compliance and delivering practical, accountable outcomes for every client.
At PHT, we believe that effective trusteeship is measured not only by experience, but by the real results achieved through diligent administration, sound decision-making and a commitment to long-term stewardship.
